Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen gelten für alle Bestellungen, die Verbraucher über unseren Online-Shop tätigen.
Unser Shop richtet sich ausschließlich an Verbraucher im Sinne von § 13 BGB.

Vertragspartner und Vertragsabschluss

(1) Vertragspartner ist:
Youvé Studio – Yael Hendriks, Messingstraße 29, 46395 Bocholt.

(2) Die Darstellung der Produkte im Online-Shop stellt ein verbindliches Angebot dar.

(3) Der Kaufvertrag kommt zustande, sobald der Kunde im letzten Schritt des Bestellprozesses auf den Button
„Zahlungspflichtig bestellen“ (Purchase) klickt (§ 312j BGB – Button-Lösung).

(4) Direkt nach der Bestellung erhält der Kunde eine Bestellbestätigung per E-Mail.

Preise und Verfügbarkeit

(1) Alle Preise sind Endpreise inklusive Mehrwertsteuer und zuzüglich Versandkosten.

(2) Wir bemühen uns um korrekte Angaben; offensichtliche Irrtümer oder technische Fehler sind nicht verbindlich.

(3) Sollte ein Artikel zum Zeitpunkt der Bestellung nicht verfügbar sein, informieren wir den Kunden unverzüglich. Bereits geleistete Zahlungen werden erstattet.

Zahlung

Folgende Zahlungsmethoden stehen zur Verfügung:

  • Kreditkarte (Visa, Mastercard, Maestro)

  • Paypal

  • Apple Pay

  • iDeal (bald verfügbar)

Die Zahlung ist sofort fällig.

Lieferung und Versand

(1) Wir liefern weltweit, sofern beim Produkt nichts anderes angegeben ist.

(2) Lieferzeiten:

  • Deutschland: 2–5 Werktage

  • Europa: 3–7 Werktage

  • Außerhalb Europas: 5–10 Werktage

(3) Versanddienstleister: DHL oder DPD.

(4) Kunden mit Liefer- und Rechnungsadresse außerhalb der EU zahlen keine Mehrwertsteuer; dies wird im Checkout automatisch berücksichtigt.

(5) Zoll- und Importkosten bei Lieferungen in Nicht-EU-Länder trägt der Kunde.

(6) Versandkosten werden im Checkout angezeigt.

Widerrufsrecht (Rückgabe)

Verbraucher haben ein 14-tägiges Widerrufsrecht ab Erhalt der Ware gemäß §§ 312g, 355 BGB.

Außerdem ist das Rücksendeformular vollständig ausgefüllt der Rücksendung beizulegen. Dieses Formular ist auf der Seite unserer Rückgaberichtlinien zu finden.

Bitte immer die Bestellnummer angeben.

Rücksendung

  • Die Ware ist sorgfältig verpackt zurückzusenden (in Originalverpackung).

  • Rücksendungen erfolgen auf eigene Kosten und Verantwortung.

  • Es muss ein nachverfolgbarer Versand genutzt werden.

  • Der Einlieferungsbeleg ist aufzubewahren.

Bedingungen für Rückgaben

Rücksendungen sind nur möglich, wenn die Artikel:

  • ungetragen, ungewaschen und unbenutzt sind

  • alle Etiketten und Verpackungen enthalten

  • keine Gerüche, Flecken, Tierhaare oder andere Gebrauchsspuren aufweisen

Bearbeitungszeit

Nach Eingang der Rücksendung benötigen wir 10 Werktage zur Prüfung und Rückerstattung.

Gewährleistung

Für Verbraucher gelten die gesetzlichen Gewährleistungsrechte nach §§ 434 ff. BGB.
Bei Mängeln kontaktieren Sie uns bitte innerhalb von 7 Tagen nach Erhalt.

Haftung

(1) Wir haften unbeschränkt bei Vorsatz und grober Fahrlässigkeit.

(2) Bei leichter Fahrlässigkeit haften wir nur für

  • Schäden aus der Verletzung des Lebens, Körpers oder der Gesundheit

  • Schäden aus der Verletzung wesentlicher Vertragspflichten (Kardinalpflichten)

Die Haftung ist dabei auf den vorhersehbaren, vertragstypischen Schaden begrenzt.

(3) Im Übrigen ist eine Haftung ausgeschlossen.

Anwendbares Recht / Gerichtsstand

(1) Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts.

(2) Für Verbraucher gelten die gesetzlichen Gerichtsstandregeln.
Sollte der Verbraucher keinen Wohnsitz in der EU haben, ist der Gerichtsstand Bocholt (Deutschland).

Scope of Application

These Terms and Conditions apply to all orders placed by consumers through our online shop. Our shop is directed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB).

Contracting Party and Conclusion of Contract

(1) The contracting party is:

(2) The presentation of products in our online shop constitutes a binding offer.

(3) A purchase contract is concluded once the customer clicks the “Purchase” (German: “Zahlungspflichtig bestellen”) button in the final step of the ordering process, in accordance with Section 312j BGB (Button Solution).

(4) Immediately after placing the order, the customer receives an order confirmation by email.

Prices and Availability

(1) All prices are final prices and include statutory VAT, plus shipping costs.

(2) We strive to provide accurate information; however, obvious errors or technical inaccuracies are not binding.

(3) If an item is not available at the time of order, we will inform the customer without delay. Any payments already made will be refunded.

Payment

The following payment methods are available:

Payment is due immediately.

Delivery and Shipping

(1) We ship worldwide unless otherwise stated in the product description.

(2) Delivery times:

  • Germany: 2–5 business days

  • Europe: 3–7 business days

  • Outside Europe: 5–10 business days

(3) Shipping carriers: DHL or DPD.

(4) Customers with a billing and shipping address outside the EU do not pay VAT; this is automatically reflected at checkout.

(5) Customers are responsible for any customs duties or import charges for deliveries to non-EU countries.

(6) Shipping costs are displayed at checkout.

Right of Withdrawal (Return Policy)

Consumers have a 14-day right of withdrawal from the date of receipt of the goods, in accordance with Sections 312g and 355 BGB.

In addition, the return form must be fully completed and enclosed with the return shipment. This form can be found on our Return Policy page.

Please always include your order number.

Returns

  • Goods must be returned carefully packaged (in the original packaging).

  • Returns are made at the customer’s own cost and risk.

  • A trackable shipping method must be used.

  • Customers must retain the shipping receipt as proof of dispatch.

Conditions for Returns

Returns are only accepted if the items:

  • are unworn, unwashed, and unused,

  • include all original tags, labels, and packaging,

  • show no odors, stains, pet hair, or other signs of wear.

Processing Time

Upon receipt of the return, we require up to 10 business days to inspect the goods and process the refund.

Warranty

Statutory warranty rights for consumers pursuant to Sections 434 et seq. BGB apply.
In case of defects, please contact us within 7 days of receiving the goods.

Liability

(1) We have unlimited liability for intent and gross negligence.

(2) In cases of slight negligence, we are only liable for:

  • damages resulting from injury to life, body, or health,

  • damages resulting from the breach of essential contractual obligations (cardinal obligations).

In such cases, liability is limited to foreseeable and typical damages.

(3) Any further liability is excluded.

Applicable Law / Jurisdiction

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) Statutory rules on jurisdiction apply to consumers.
If the consumer has no residence within the EU, the place of jurisdiction shall be Bocholt, Germany.
